Barcena Sponsored by: Comm. on Ways and Means WHEREAS, the Ynares Sports Center situated at Circumferential Road, Barangay San Roque, Antipolo City is owned and operated by the Province of Rizal; SHCaDA WHEREAS, the existing city ordinance has subjected the admission charges on activities conducted within the Ynares Sports Center to an amusement tax at the rate of 30% of the gross receipts thereof; WHEREAS, under Section 192 of the Local Government Code of 1991, states that "the local government units may, through ordinance duly approved, grant tax exemption, incentives or relief under such terms and conditions as they deem necessary"; WHEREAS, despite the prestige it brings to the Province of Rizal and the City of Antipolo, the revenue generated by the Ynares Sports Center is not sufficient to defray the cost of its overhead expenses and payment of 30% amusement tax shall eventually result to increase on the prices of admission charges and rentals to the detriment of its clients, the majority of whom are Rizaleos and Antipoleos and henceforth adverse to the priority program of the Provincial Government as well as to the general welfare of the people of Rizal as expressed by the Hon. Governor Casimiro A. Ynares III in a communication dated January 19, 2009; WHEREAS, the grant of an amusement tax exemption to the Rizal Provincial Government on the operation of Ynares Sports Center for the year 2008 shall alleviate the plight of the province and will manifest the support of Antipolo City to the province. NOW THEREFORE, BE IT ENACTED BY THE SANGGUNIANG PANLUNGSOD IN REGULAR SESSION ASSEMBLED, THAT: SECTION 1. For purpose of this Ordinance, the Provincial Government of Rizal is hereby granted an amusement tax exemption on the operation of the Ynares Sports Center situated at Circumferential Road, Barangay San Roque, Antipolo City for the period January 1, 2009 to December 31, 2009. BARCENA WHEREAS, the Ynares Sports Center, situated at Circumferential Road, Barangay San Roque, Antipolo City is owned and operated by the Province of Rizal; ITAaHc WHEREAS, the existing city ordinance has subjected the admission charges on activities conducted within the Ynares Sports Center an amusement tax at the rate of 30% of the gross receipts thereof; WHEREAS, under Section 192 of R.A. 7160 or the Local Government Code of 1991 states that "the local government units may, through an ordinance duly approved, grant tax exemption, incentives or relief under such terms and conditions as they deem necessary"; WHEREAS, although Ynares Sports Center brings such prestige to the City of Antipolo being an occasional venue of activities broadcasted through national media, the revenue generated by it do not suffice the coverage of the cost of the whole year overhead expenses it incurs; WHEREAS, payment of 30% amusement tax will eventually result to increase on the prices of admission charges and rentals of facilities which might be detrimental to its clients, majority of whom are Antipoleos especially in this time of global crisis; WHEREAS, the grant of an amusement tax exemption to the Rizal Provincial Government on the operation of Ynares Sports Center for the year 2009 shall alleviate the plight of the province and will manifest the City Government of Antipolo to the province. YNARES, III, M.D. FOR GRANT OF AMUSEMENT TAX EXEMPTION ON THE OPERATIONS OF YNARES CENTER FOR THE YEAR 2009" Strongly recommending the adoption of this report and the appropriate action by the Sangguniang Panlungsod Submitted to : Hon. LORENZO M. ZAPANTA City Vice Mayor/Presiding Officer Date : February 09, 2009 Findings/Conclusions/Recommendations: Referred to and standing before the Committee on Ways and Means for appropriate action is the request for amusement tax exemption on the operation of the Ynares Center by the Honorable Governor of Rizal through a letter dated January 19, 2009 to the Hon. City Mayor Danilo O. Leyble, and after careful study and due evaluation, this committee has the honor to report the matter back to the Sangguniang Panlungsod with the following findings, conclusions and recommendations: 1. Ynares Sports Center has brought such a prestige to the City of Antipolo being a facility, which is occasionally used for activities covered by national media and somehow introduced the name of the city to millions of people nationwide. 2. It has been instrumental to the increase in number of visitors and pilgrims in this city not just during selected festivities but almost constantly which eventually increased the income of the city and the business sector, elevating the economic standing of our residents. ICAcTa 3. However, the operational expenses of the center exceed the revenue generated by the center for the reason that the prices of entrance tickets are so minimal in amount for the benefit of the Rizaleos, which includes our residents. Hence, payment of the amusement tax shall add up to its expenses and shall therefore result to increase of entrance fees, affecting obviously its clients and might be detrimental to the purpose of the center for our inhabitants. 4. Granting the amusement tax exemption to the Provincial Government of Rizal for the aforementioned facility shall not only alleviate the plight of the province and will manifest our support to it but will be likewise beneficial to our city and its inhabitants. It is therefore the recommendation of this committee to grant the requested amusement tax exemption by the Provincial Government of Rizal for the operation of Ynares Sports Center for the year 2009. Once again, this Office would like to express its most sincerest gratitude to the Sangguniang Panlungsod of Antipolo City for granting amusement tax exemption to the Provincial Government of Rizal for the operation of Ynares Center during the past years. cDEHIC The Ynares Center, despite the prestige it brings to our Province and the City of Antipolo, is operating on the meager budget coming from the Provincial Government. Due to unavailability of plantilla positions, the maintenance personnel and officers working therein are detailed personnel coming from the different departments/offices of this Provincial Government. Income generated during the previous years of operations were not sufficient to defray its overhead expenses as well as the cost of maintenance. Payment of the amusement tax of 30% on gross sales receipts would naturally cause the untimely increase in the basic prices of tickets and rentals, to the detriment of the prospective clients of Ynares Center majority of whom are Rizaleos and henceforth adverse to priority programs of the Provincial Government as well as to the general welfare of the people of Rizal. In view thereof, we wish to respectfully request from the Sangguniang Panlungsod of Antipolo City for another grant of amusement tax exemption on the operations of Ynares Center for the year 2009.
