Barcena Sponsored By: Comm. on Ways and Means WHEREAS, among the fees authorized to be imposed, and collected by the city as embodied in the Revised Revenue Code of Antipolo (2000) are the Local Civil Registry Fees, specifically those enumerated in Chapter IV, Article B, Section 4B.01 of the said code; ScCIaA WHEREAS, Section 186 of the Local Government Code of 1991 provides: "SEC. 186. Power to Levy Taxes, Fees or Charges. Local government units may exercise the power to levy taxes, fees or charges on any base or subject not otherwise specifically enumerated herein or taxed under the provisions of the National Internal Revenue Code, as amended other applicable laws: Provided, that the taxes, fees, or charges shall not be unjust, excessive, oppressive, confiscatory or contrary to declared national policy: Provided, further, That the ordinance levying such taxes, fees or charges shall not be enacted without any prior public hearing conducted for the purpose"; WHEREAS, the fees provided for under Chapter IV, Article B, Section 4B.01 of City Ordinance No. 65-2000, the "Revised Revenue Code of Antipolo City (2000)" are no longer realistic and reasonable, considering that fees were imposed at least seven (7) years now and there is a need to adjust the said fees to a more realistic level for which reason, this august body has recognized the necessity to amend the said Ordinance by adjusting the fees provided therein. NOW THEREFORE, BE IT ENACTED BY THE SANGGUNIANG PANLUNGSOD IN REGULAR SESSION ASSEMBLED, THAT: SECTION 1. For purpose of this Ordinance, Chapter IV, Article B, Section 4B.01 of City Ordinance No. 65-2000, the "Revised Revenue Code of Antipolo City (2000)" is hereby amended to read as follows: Section 4B.01. Imposition of Fees. There shall be collected the following registry fees and other services charges, viz. : a) Marriage Related Fees: 1. Registration of Marriage Free of Charge* 2. License Fee 100.00 3. Solemnization Fee 150.00 4. Family Planning Fee 100.00 b) Birth Related Fees: 1. Registration of Birth Free of Charge* 2. Late Registration of Birth Free of Charge* 3. Certified true copy of Birth Certificate for local use 50.00 for travel abroad 100.00 4. Authority to Use Surname of 200.00 Father (AUSF) c) Death Related Fees: 1. Registration of Death Free of Charge* 2. Certified true copy of birth certificate for local use 50.00 for abroad purposes 100.00 3. Burial Permit Fee 100.00 4. Cremation Fee 300.00 5. Exhumation of cadaver 300.00 6. Transfer of cadaver to other 200.00 place 7. Interment of Cadaver 200.00 8. Certified true copy of Death 50.00 Certificate (NOTE: As a national policy, registration of births, deaths, marriages and foundlings is FREE OF CHARGE pursuant to the provisions of OP-Proclamation No. 326 dated February 14, 1994 as amended by Proclamation No. 4376 dated August 9, 1994 issued by the Office of the President and under an Unnumbered Memorandum from the Office of the Civil Registrar General dated February 16, 1994 and also under DILG MC-94-154 dated September 8, 1994.) d. Penalty. Any violation of the provisions of this Ordinance shall be punished by a fine of not less than One Thousand (Php1,000.00) Pesos but not more than Three Thousand (Php3,000.00) Pesos or imprisonment of not less than one (1) month but not more than six (6) months or both such fine and imprisonment depending on the discretion of the court. For City Government employee, termination of employment, without prejudice to the filing of criminal and civil cases to the proper court for such violator. SECTION 3. All ordinances, issuances, rules and regulations or parts thereof which are inconsistent with or contrary to the provisions of this Ordinance are hereby repealed, amended or modified accordingly. SECTION 4. If for any reason, any section or provision of this Ordinance is declared illegal or unconstitutional, the other sections or provisions hereof which are not affected thereby shall continue to be in full force and effect. cEaCTS SECTION 5. This Ordinance shall take effect fifteen (15) days after its approval and complete publication in a newspaper of local circulation. The full text of this Ordinance shall likewise be posted in at least two (2) conspicuous places in the City of Antipolo as per compliance with the posting requirements mandated by the Local Government Code of 1991 (RA 7160).
