ALAMINOS CITY ORDINANCE NO. 006-17 ORDINANCE IMPOSING RENTAL AND FIXING THE RATES ON THE USE OF THE FACILITIES AT THE HUNDRED ISLANDS NATIONAL PARK AND AT LUCAP WHARF, ALAMINOS CITY, PANGASINAN Sponsor: Councilor Carolyn D. Sison Co-Sponsor: Councilor Alfred Felix E. de Castro EXPLANATORY NOTE WHEREAS ,the Local Government Unit of Alaminos City, Pangasinan in its thrust to make the City a prime tourist destination in Region I, recently upgraded the facilities at the Hundred Islands National Park and at Lucap Wharf; CDHaET WHEREAS , Article 129 of Republic Act 7160, otherwise known as the Local Government Code of 1991 in relation to Article 10, Section 5 of the 1987 Philippine Constitution provides, "Each Local Government Unit shall exercise its power to create its own sources of revenue and levy taxes, fees, and charges subject to the provisions herein, consistent with the basic policy of local autonomy. Such taxes, fees, and charges shall accrue exclusively to the local governments." WHEREAS , Article Five, Section 153 and Section 154 of Republic Act 7160 further provides that the Local Government Units may impose and collect reasonable fees and charges for services rendered and may fix the rates for the operation of public utilities owned, operated and maintained by them; WHEREAS ,the City Government-Alaminos City intends to maximize the use of its resources and create additional source of income by renting out these facilities; WHEREFORE ,premises considered, and on motion of Councilor Alfred Felix E. de Castro, duly seconded by all the members present. BE IT ENACTED as it is hereby ENACTED by the Sangguniang Panlungsod of the City of Alaminos, Pangasinan in session duly assembled that: SECTION I. Title of the Ordinance . This ordinance shall be known as an " ORDINANCE IMPOSING RENTAL AND FIXING THE RATES ON THE USE OF THE FACILITIES AT THE HUNDRED ISLANDS NATIONAL PARK (HINP) AND AT LUCAP WHARF, ALAMINOS CITY, PANGASINAN ." SECTION II. Definition of Terms . ISCDEA DAY TOUR as used in this Ordinance shall mean that the guests will be at the Hundred Islands National Park anytime between six o'clock in the morning (6:00 am) and five thirty o'clock in the afternoon (5:30 pm) of the same day. OVERNIGHT shall mean that the guests will be at the Hundred Islands National Park anytime between six o'clock in the morning (6:00 am) and twelve noon (12:00 noon) the following day. SECTION III. Fees and Rental Rates . Rental rates herein imposed shall be fixed regardless of the length of time of use of the facilities at the Hundred Islands National Park on Day Tour or Overnight. TaCEHA Check-in time for guest house will be at 2:00 o'clock in the afternoon and check-out will be 12:00 noon the following days. The Barangay Council of Brgy. Lucap, this city shall have a twenty percent (20%) share in the amount collected as Parking Fee pursuant to this ordinance. The Local Finance Committee shall review the economic feasibility of the provisions of this ordinance every two (2) years and recommend appropriate actions if necessary. SECTION IV. Separability Clause . If any provision of this ordinance or the application of such provision to any person or circumstance is declared invalid, the remainder of this ordinance shall not be affected. SECTION V. Repealing Clause . All ordinances, resolutions and other issuances or parts thereof inconsistent herewith, are deemed repealed or modified accordingly. SECTION VI. Effectivity .
